Services, provided by "Condor Journeys and Adventures (CJA)", do not include transatlantic nor domestic flights. Some journeys such as cruises have different sales conditions. Each quotation or invoice will mention these special conditions in detail.
1. The contract
The contract is between "Condor Journeys and Adventures" and the client, being any person
travelling or intending to travel on a tour operated by us. You, the client, are subject to have read and understood
our travel policy and the paragraphs below.
These conditions only apply to services included in our program, but do not apply to
flights. These are subject to the conditions imposed by the airlines.
2. Brochure Prices and Quotations
In the first instance, most clients contact us by mail, e-mail or telephone. If you are happy with the tour as quoted, simply
fill in the booking form and return it together with your deposit, having checked the availability and validity of the price. Otherwise,
one of our specialist staff will discuss with you the broad requirements of your itinerary, and use their experience to suggest routing,
timings and accommodation. Upon receiving your approval, we will mail you a quotation, describing the services, the routing and the price.
The validity of our quotations is 30 days.
3. Acceptance of your booking
To secure a booking, "Condor Journeys and Adventures" requires a fully completed and signed booking
form together with the necessary deposit (full payment for travel within 60 days). Clients
are deemed to have read and understood the conditions and are required to confirm this by signing
the booking form. We will issue a confirmation invoice within 5 working days, at which point we have accepted your booking
and a contract exists and the deposit becomes non-refundable and non-transferable. However, in the case of certain tailor-made itineraries, please allow us time to
communicate with Latin America - this sometimes takes a week or more. If we are unable to confirm your booking, we will
refund your deposit in full. CJA reserves the right to decline any booking at their discretion.
4. Final payment
The balance, including any surcharges applicable, must be
paid to CJA or their agent no later than 60 days before departure. In the case of non-payment
of the balance by the due date, CJA reserves the right to cancel your booking and cancellation
charges will apply (see § 7).
5. Alteration before departure
We will try to assist you if you decide to change any part of a confirmed journey
up to 60 days before departure. We will charge you an administration fee of £25 per person plus any
additional costs incurred. Alterations within 60 days of departure will be treated as cancellations
and will be subject to penalties (see § 7).
6. Transferring your booking
If a client is unable to travel, the booking might be transferred to another suitable person, if all suppliers
agree. If a transfer is allowed, CJA will levy an administration charge of £40 per person (no later than 60 days
before departure) or £100 per person (within 60 days of departure), plus any extra charges levied by our suppliers.
7. Cancellation by you
Any client who wishes to cancel, must do so in writing and the following fees or percentages apply.
These fixed fees or percentages are calculated from the day your written notification sent by post
or fax is received by CJA, including surcharges, as shown below :
- 60 and more days before departure : retention of deposit
- 59 to 30 days before departure : 60% of total price
- Less than 29 days : 100% of price
Please note that for cruises, the cancellation conditions may differ from the above.
We strongly recommend you to take out full insurance cover, which, under certain circumstances, covers you against the
loss of deposits or cancellation charges.
8. Cancellation or alteration by "Condor Journeys and Adventures"
While the Company endeavours to operate all tours as advertised, it
reserves the right to change any of the facilities, services, prices or itineraries described
in the programme. If a major change is necessary or deemed advisable, CJA will
inform the client before you depart.
A major change does not apply to a change of carrier, transport or named accommodation.
It is normally considered to be a major itinerary re-routing, a significant change in the duration
of your holiday or the cancellation of a major excursion with no reason. CJA will not accept liability for
changes in flight schedule or departure airport, but we will do our best
to minimise their effects on your journey.
Provided that the major change is not as a result of situations outside CJA control or consolidation (see below),
the client will have the choice of accepting the changes (at additional cost if applicable), purchasing another
available tour from CJA, or cancelling the tour with a full refund(see below).
Compensation will be paid as follows:
- More than 42 days: Nil
- 41 to 28 days: £20
- 27 to 14 days: £30
- 13 days to date of travel: £40
CJA will not pay compensation if forced to cancel or change your tour because of war, threat
of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster,
fire or adverse weather conditions, epidemics or health risks, technical or maintenance problems
with transport, closed or congested airports or ports, changes imposed by re-scheduling or
cancellation of flights by airlines, the alteration of airlines or aircraft
types, or other similar events beyond the control of CJA. Consolidation refers to the fact that
some tours are dependent upon a minimum number of persons participating.
We reserve the right to cancel a tour in any circumstances but will not cancel a tour less than 8 weeks
before departure, except for force majeure, consolidation or the clients failure to pay the final
balance. Unless the client fails to pay the final balance, CJA will return all deposits paid or
offer an alternative tour of comparable standard and will pay compensation on the scale shown above. No
compensation will be paid if cancellation is due to force majeure or consolidation.
9. Complaints
If you have a problem during your holiday, it is a condition of this contract that you communicate this directly to the supplier
of the services and our local representative in Latin America. If you fail to follow this simple
procedure, we cannot accept responsibility as you will have deprived us the opportunity to investigate and
rectify the problem. If the problem remains unsolved, please write to us within 28 days of your return; we will
acknowledge receipt and investigate.
10. Travel and Cancellation Insurance
Travel Insurance is mandatory for all clients whilst on a tour organised by CJA. You must send us details of your policy. It remains your responsibility
to ensure you are adequately covered by your insurance.
11. Clients' Responsibility
Clients must be in possession of, and are responsible for arranging, a valid passport, visa and
vaccination certificates, etc, required for the whole of their journey. Information about
these matters and related items (climate, clothing, baggage, etc) will be provided
to you, but CJA can not be held responsible for any of this information.
Clients agree to accept the authority and decisions of CJA employees, CJA's supplier
employees, tour leaders and agents whilst on tour with CJA. If, in the opinion of such person,
the health or conduct of a client, at any time before or after departure, appears likely to endanger
the safety, comfort or happy progress of a tour, he/she may exclude the client from all or part of
the tour. In the case of ill-health, the company may make arrangements as it deems necessary,
and recover the costs thereof from the client. If a client commits an illegal act, he/she may be
excluded from the tour and CJA responsibility shall cease to exist.
The person, signing the attached booking form (which incorporates these terms), warrants that
he/she has full authority to do so on behalf of all persons whose names appear thereon, and
confirms that all such persons are fully aware of and accept these conditions. No refund will be
given for any unused services
12. Financial Security
Condor Journeys and Adventures fully complies with the
current European Regulations regarding the protections of clients' money.
13. Prices
a) Exchange rates
Prices quoted are based on currency rates as applicable at date of quote.
The price of a journey may be varied at any time before we accept your booking. Prices remain unconditionally valid for
30 days from date of invoice. If we receive full payment on or before the 30th day, we guarantee not to surcharge you.
b) Surcharges
CJA reserves the right to increase the tour cost to take into account the following items:
Government actions, currency fluctuations, transportation costs (including the cost of fuel),
airport charges and increases in scheduled air fares. The company will absorb a sum, equal to 2%
of the tour cost, should a surcharge be necessary. This does not apply to government taxes, imposed after
publication of our programs and amendment charges. The client will have to
pay any sum in excess of this 2%. If the surcharge results in an increase of more than 10% of
the tour cost, excluding government taxes and amendment charges, the client may
cancel the booking within 7 days of notification of the surcharge and obtain a full refund. You will be
notified of any such surcharge as soon as it occurs.
14. Delays/Flights
We cannot accept liability for any delay in your flight from or to Latin America, whether the cancellation or delay is
caused by adverse weather conditions, rescheduling of the airline, airport authority and/or action
by air traffic controllers, mechanical breakdown, industrial action or under any other
circumstance. Where long flight delays result in lost holiday time,
hotels or suppliers give no refunds. Similarly, airlines do not offer compensation for flight delays.
However, at their discretion, carriers will endeavour to reduce the inconvenience of any
delay by providing meals and accommodation, as appropriate for the time of day or night
(dependent on local availability). If you incur payments for such services in the event of a
delay, CJA will not accept responsibility for payment unless we have given our prior consent.
15. Our Responsibilities
Clients bookings are accepted on the understanding that they appreciate the possible risks,
inherent to adventure travel and that they undertake the tours, treks or expeditions, featured
in our program, at their own risk. It is also important to understand that the most
meticulously planned arrangement can go wrong. After all, Latin America is a developing continent
with more basic infrastructure. Nor do the high altitudes of the Andes, or the tropical
vastness of the Amazon, lend themselves to creature comforts. Conditions are such that there may be moments
of discomfort and delays, mainly due to the Latin American way of life. CJA can not accept complaints due to these aspects.
a) Where the client does not suffer personal injury, the company accepts liability
should any part of the tour arrangements, booked with the company, not be supplied as described in
this brochure. In such case, the company will pay reasonable compensation if the clients
enjoyment of the tour arrangements has been adversely affected. Under no condition will we pay any
compensation if there has been no fault on the part of CJA or its suppliers or the reason for the failure
was the client's own fault, the action of someone unconnected with the tour arrangements,
or could not have been foreseen or avoided by CJA or its suppliers, even if all due
care had been exercised.
b) Where the client suffers death or personal injury as a result of an activity
forming part of the tour arrangements booked with CJA, CJA accepts responsibility unless there
has been no fault on CJA's part or its suppliers and the cause was the client's fault, the
action of someone unconnected with the tour arrangements, or one which neither the company nor
its suppliers could have anticipated or avoided, even with the exercise of all due care.
c) CJA's acceptance of liability to pay compensation pursuant to clauses 15(a) and
15(b) is limited, in the case of air travel, rail travel, sea travel or hotel accommodation, to
the amount set out in the provisions of, respectively, the Warsaw Convention as amended by the Hague
Protocol 1955, the 1961 Bern Convention, the 1974 Athens Convention and the 1962 Paris Convention.
d) CJA's acceptance of liability in clauses 15(a) and 15(b) above is subject to
assignment by the client to CJA of the client's rights against any agent, supplier or
subcontractor of CJA, which is in any way responsible for the unsatisfactory holiday arrangements
or the client's death or personal injury.
